This document explains the terms in which XperiencePhoto (GOBASA Lda headquartered at Centro Empresarial de Idanha-a-Nova, Zona Industrial de Idanha-a-Nova, 6060-182 Idanha-a-Nova, with the unique number of legal person 516 442 570) collects, uses and processes the data and information of its users through its applications. The rules for the collection, use and processing of data and information are in accordance with applicable national legislation and the Personal Data Protection Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016.

XperiencePhoto (henceforth as “XperiencePhoto“) cares about the privacy of its users as well as the personal data submitted by them, being responsible for the website https://xperiencephoto.com (henceforth as “Site”) and the Application for mobile devices XperiencePhoto (henceforth as the “App”).

This Privacy Policy applies to data collected and processed within the scope of user interaction with the XperiencePhoto website or platforms.

XperiencePhoto collects data from its users through the following platforms:

Identification and contact: contact number associated with the device where the App is installed.

Under Age Data

XperiencePhoto doesn’t knowingly collect (or distinguish) data from minors under the age of 16. However, in case, with the information that data from minors were collected, XperiencePhoto will immediately proceed to delete them.

XperiencePhoto uses the collected data for the following purposes:

  • Availability of its services to the user;
  • Provision of user support;
  • Compliance with contractual and legal obligations;
  • Improve the functioning of the Site and App;
  • App update notification;

XperiencePhoto users own and can exercise the following rights regarding their personal data:

Right to Information – at the time of collection or processing, the holder of personal data has the right to be informed about the purpose of the treatment, the person responsible for processing the data, entities to which their data may be communicated, conditions of access and rectification and which mandatory and optional data will be collected;

Right of Access – the holder of personal data has the right to access them, without restrictions or delays, as well as to know what information is available about the origin of the data, purposes of treatment and communication of the same to third parties;

Right of Rectification – the holder has the right to demand that the data concerning him/her are accurate and current, being able at any time to request its rectification from the person responsible for processing XperiencePhoto‘s data;

Right of Erasure – the data subject has the right to have his/her data cease to be processed, be erased and eliminated, under certain conditions, in the event of:

  • are no longer necessary for the purpose for which they were collected;
  • the holders withdraw their consent or oppose their treatment;
  • if the processing of the data does not comply with the legal provisions.

Right to Limitation of Treatment – the holder of personal data has the right to have their data limited only to what is essential for the purpose of treatment;

Right to data portability (data transfer) – the data subject has the right to receive their data or request their transmission to another entity that becomes the new responsible for their personal data (only if it is technically possible);

Right of Opposition – the data subject has the right to object, at his request and free of charge, to the processing of his personal data for the purposes of direct marketing or any other form of prospecting and that his personal data are communicated to third parties, unless otherwise provided by law;

Right to Knowledge of the existence of a data breach – the holder of personal data has the right to be informed if there is any security breach that compromises their data;

Right of Complaint to the supervisory authority – the holder of the personal data has the right to complain not only to the person responsible for processing the XperiencePhoto’s personal data, but also to the supervisory authority, the National Data Protection Commission.

 

Data Retention Term

The data collected are processed for the period strictly necessary to achieve the specific purpose of each one.

The identification data of registered users and the list of saved reading articles are kept as long as the relationship with the user is maintained. Therefore, they will remain until the user deletes their registration on XperiencePhoto or requests their deletion/cancellation of their subscription.

For the purposes of commercial transactions and compliance with legal invoicing obligations, the data will be kept for the period legally established for the fulfillment of legal obligations, as well as for contesting legal situations and for the period they remain.
